AKA PACHA Travel Tour Operator is a legally registered Bolivian company dedicated to providing high-quality ethno-ecological and adventure tourism experiences. The Client's (hereinafter "you") relationship with AKA PACHA (hereinafter "we," "us," or "the company"). By using our services or booking a tour, you agree to all of these terms.
1. Booking & Confirmation
- Direct reservations can be made via our office, website, email, or through agents with the proper authorization.
- Personal information, including complete name, passport number, nationality, date of birth, phone number, and email, is required for all reservations.
- Only after receiving a deposit or full payment and receiving a written confirmation is a tour confirmed.
2. Payment Policy
- A 30% deposit is required to secure your booking.
- The remaining balance must be paid at least 7 days before the tour begins.
- Full payment must be received at the time of booking if the reservation is made fewer than seven days in advance.
- We take bank transfers, credit/debit cards (with possible fees), and cash (USD/Bolivianos).
3. Cancellations & Refund Policy
- All cancellations must be made in writing and acknowledged by us.
- Refunds will be issued as follows:
- 30 or more days before the tour: 90% refund of deposit.
- 15–29 days before the tour: 50% refund.
- Less than 15 days before the tour: No refund.
- No refunds are available once the tour has started.
- Insufficient reservations, bad weather, natural disasters, political upheaval, or any other circumstance beyond our control may cause AKA PACHA to cancel tours. A complete refund or a rescheduled tour will be provided in such circumstances.
4. Tour Modifications
a. By the Client:
- You may request changes to your itinerary up to 7 days before the departure date.
- We will do our best to accommodate changes, though they may incur additional costs.
b. By the Company:
- In the event of operational issues, safety concerns, bad weather, or unanticipated events, we reserve the right to change itineraries.
- We will notify you as early as possible of any major changes.
5. Travel Insurance
- Comprehensive travel insurance is mandatory for all travelers.
- Medical costs, trip cancelation, misplaced luggage, personal accidents, and adventurous activities (if relevant) should all be covered by your insurance.
- Proof of valid insurance must be provided upon request.
6. Health and Safety
- It is your responsibility to ensure that you are physically fit for the selected tour.
- All medical conditions, allergies, or disabilities must be disclosed at the time of booking.
- AKA PACHA may refuse participation if there is a risk to the individual’s or group’s safety.
7. Personal Responsibility
- It is expected of clients to abide by local laws and customs and to follow the guidance provided.
- The customer is financially liable for any harm done to local communities, property, or equipment.
- It is expected of clients to always act with decency and consideration for the environment.
8. Force Majeure
- In the event of a natural disaster, war, political unrest, pandemic, strike, or other uncontrollable occurrence, AKA PACHA shall not be held responsible for any delays, modifications, or cancellations of tours.
- In such cases, we will work to reschedule or offer an alternative, but refunds may not be guaranteed.
9. Passports, Visas & Entry Requirements
- You are responsible for obtaining valid travel documents (passport, visa, vaccinations).
- No refunds will be given for missed tours due to invalid or missing documents.
10. Limitation of Liability
- Unless there is proof of fault, AKA PACHA is not liable for any harm, losses, or damages sustained while taking part in any trip or activity.
- We represent hotels, transportation companies, and other service partners as their representatives and are not responsible for their deeds.
11. Marketing & Photography
- During your tour, photos and videos may be taken by guides or staff.
- Unless the customer expressly objects in writing prior to the start of the trip, these could be used in future marketing.
12. Feedback & Complaints
- We value your experience and encourage feedback after your trip.
- If you have a complaint during your tour, please inform your guide or contact us immediately so we can resolve the issue in real-time.
13. Legal Jurisdiction
- These Terms and any disputes will be governed by and interpreted in accordance with the laws of the Plurinational State of Bolivia.
- Any legal actions will be subject to Bolivian jurisdiction in the city of La Paz.
